9Our Application

Application User Tracking Experience

9.1

We may use diagnostic software, mobile telemetry tools, cookies and digital analytics technologies across our Application to review platform performance, enhance system security, and continuously improve user experience.

9.2

For the Application, the admin portal or backend will have visible access to active data which is viewable for technical and product support.

9.3

When accessing our website, the website server makes a record of the visit and logs the following information for statistical and administrative purposes:

a.

the user’s server address – to consider the users who use the website regularly and tailor the website to their interests and requirements;

b.

the date and time of the visit to the website – this is important for identifying the website’s busy times and ensuring maintenance on the website is conducted outside these periods;

c.

pages accessed and documents downloaded – this indicates to us which pages or documents are most important to users and also helps identify important information that may be difficult to find;

d.

duration of the visit – this indicates to us how interesting and informative our website is to users;

e.

the type of browser used – this is important for browser specific coding; and

f.

in order to optimise our website and better understand its usage, we collect the visiting domain name or IP address, computer operating system, browser type and screen resolution.

9.4

We may use advertising products, such as remarketing with Facebook, Google Analytics and Google Analytics Demographics and Interest Reporting. Google Analytics collects data about our website traffic via Google Advertising cookies and anonymous identifiers.

9.5

Data collected via these Google products is not linked with any personally identifiable information you submit while on our website. If you wish to opt out of the Google Analytics data collection, you may do so on Google's website at tools.google.com/dlpage/gaoptout.

Cookies

9.6

When you access our website, we may send a “cookie” (which is a small summary file containing a unique ID number) to your computer. This enables us to recognise your computer and greet you each time you visit our website without bothering you with a request to register. It also enables us to keep track of products and/ or services you view so that, if you consent, we can send you news about those products and/ or services.

9.7

We also use cookies to measure traffic patterns, to determine which areas of our website have been visited and to measure transaction patterns in the aggregate.

9.8

We use this to research our users’ habits so that we can improve our online services. Our cookies do not collect personal information. If you do not wish to receive cookies, you can set your browser so that your computer does not accept them. We may log IP addresses (that is, the electronic addresses of computers connected to the internet) to analyse trends, administer the website, track users’ movements, and gather broad demographic information.

9.9

The website may contain content and sharing tools embedded from various social networks. These suppliers may use and place cookies on your device. We do not have access to, and cannot control, these cookies or the personal data and information that they may collect. You therefore need to check the websites of these suppliers to get further information on how they manage cookies and what information their cookies collect.

Transmission Security and Application

9.10

As our website is linked to the internet, and the internet is inherently insecure, we cannot provide any assurance regarding the security of transmission of information you communicate to us online.

9.11

We also cannot guarantee that the information you supply will not be intercepted while being transmitted over the internet. Accordingly, any personal information or other information which you transmit to us online is transmitted at your own risk.

9.12

Our Application relies on field communications transmitted over mobile telecommunications networks and public internet infrastructure. We use hypertext transfer protocol secure (HTTPS) and transport layer security (TLS) for secure data transmission, and we use the supabase API (Supabase) with row level security (RLS) to restrict access to user data.

9.13

While we enforce such industry-standard cryptographic protocols, data transmission over wireless internet carries inherent network risks that cannot be totally eliminated.

9.14

Consequently, any data transmitted wirelessly via our Application is transmitted at your own risk prior to receipt by our infrastructure. Once data reaches our cloud servers, we enforce strict firewall defences, access controls, and administrative protections to safeguard data security.

External Links and Third-Party Integrations

9.15

Our Application may provide links to websites outside of our Application, as well as to third-party websites. These linked sites are not under our control, and we cannot accept responsibility for the conduct of any companies, businesses, affiliates, advertisers and sponsors, linked to our Application.

9.16

Before disclosing your personal information on any other website or to any third party, we advise you to examine the terms and conditions of using that website and its privacy policy. Third-party websites are responsible for informing you about their own privacy practices.

10.1

If you participate in a discussion forum, chat room or webinar (whether hosted by us or not), you should be aware that the information you provide there will be made broadly available to others, potentially inside or outside us, who have access to that discussion forum or chat room. Also, please recognise that individual forums and chat rooms may have additional rules and conditions. Each participant's opinion on a forum or chat room is his or her own and should not be considered as reflecting the opinion of us.

10.2

Please be advised that for any forums or webinars you attend, recordings can be enabled by a meeting or webinar host. By signing up for any of these, or any other host authorised by our webinar services or otherwise using them in any way, including without limitation by attending any of our meetings or webinars, you expressly acknowledge that we may make and store recordings for meetings or webinars, and may make such recordings available to hosts and other attendees at the direction of us. If you do not want to be recorded, you can choose to leave the meeting or webinar.

11Automated decision-making

11.1

We may use computer programs, algorithms, APIs, machine learning tools, or other automated processing technologies within our operations and through our APIs to analyse personal information and sensitive information to provide, personalise, support and improve our AI-enabled personal training, fitness guidance, workout planning, coaching recommendations, progress tracking, and related products and services.

d.

assessing whether particular exercises, programs, workouts, training modes, subscription features, or advanced coaching functions may be suitable for you, having regard to the information you provide through the Application.

11.4

Automated processing is designed to support consistent, efficient and personalised fitness recommendations. Where an automated assessment generates recommendations, reports, workout plans, exercise substitutions, training pathways, or other outputs that could reasonably be expected to significantly affect your use of the Application, your training decisions, or your participation in particular app features, those outputs are provided for general information and personal training support only and are not a substitute for medical, allied health, or other professional advice.

11.5

Where appropriate:

a.

the relevant recommendation, report, workout plan, exercise substitution, or training pathway may be reviewed by authorised personnel before any final action is taken by us in relation to your account or access to particular features; and

b.

Automated outputs are not used as the sole determinant of any decision that would materially affect your access to the Application or a core feature without an opportunity for human appraisal, where required by law or where otherwise appropriate.

11.6

If you have questions regarding an automated assessment, want to understand the types of information or criteria used to generate an AI-enabled recommendation, report, workout plan, exercise substitution, training pathway, or other automated output, or want to request a human review of an automated report or decision, you may contact our Privacy Officer at contact@nexawebdev.com. Our team will review your request and provide a written explanation or arrange for a manual reassessment where appropriate.

14.2

We strive to ensure the security, integrity and privacy of personal information that you submit to us through our Application. Unfortunately, no data transmission over the internet can be guaranteed to be totally secure.

14.5

We may hold your information in either electronic or hard copy form. Personal information is destroyed or de-identified when no longer needed or when we are no longer required by law to retain it (whichever is the latter).

14.6

Should a data breach involving personal information occur:

a.

We will take positive steps to address the breach in a timely manner and take remedial action such that the data breach does not result in serious harm.

b.

We will undertake reasonable and expeditious assessment to determine if it is an ‘eligible data breach’, that is a breach likely to result in serious harm to any individual affected.

14.7

In compliance with Privacy Amendment (Notifiable Data Breaches) Act 2017 (Cth), we agree that if we become aware of reasonable grounds to believe an eligible data breach has occurred, we will promptly notify the Office of the Australian Information Commissioner, the Australian Data and Insights Association and the affected individuals at likely risk of serious harm.

15How long do we retain your personal data?

15.1

We will only keep your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
